Welcome to esc. These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you", "user"), and Bedroomlabs SRL ("we", "us", "our"), concerning your access to and use of the esc. mobile application, our custom e-commerce storefront, and the physical esc. hardware device (collectively, the "Ecosystem").
By purchasing the physical esc. hardware device, downloading the esc. mobile application, or interacting with our custom web storefront, you explicitly acknowledge that you have read, understood, and agreed to be bound by these entire Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Ecosystem, and you must immediately discontinue use of the software and hardware components.
We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time. We will alert you about any changes by updating the "Last Updated" date of these Terms. It is your responsibility to periodically review these Terms to stay informed of updates. Your continued use of the Ecosystem after revised Terms are posted implies automatic contractual acceptance of the modifications.
The Ecosystem is intended for users who are at least 13 years of age. If you are between the ages of 13 and 18, you represent and warrant that you have received explicit parental or legal guardian consent to purchase the hardware and utilize the software application under their supervision.
Account creation is handled exclusively within the local esc. mobile application interface. You agree to provide accurate, current, and complete information during the device provisioning sequence. You are solely responsible for maintaining the confidentiality of your local application authentication data and for all activities that occur under your provisioned environment. We reserve the absolute right to terminate accounts or restrict device integration access if any information provided is found to be fraudulent, inaccurate, or in direct violation of these Terms.
All physical hardware purchases made via our custom web storefront are processed dynamically through the Shopify Storefront API and its tokenized secure payment gateways. By executing a purchase, you agree to provide a valid, authorized payment method.
At launch, access to the core esc. application features and physical pairing architecture is granted via a one-time hardware purchase model with no mandatory recurring fees. You explicitly acknowledge that Bedroomlabs SRL reserves the right to introduce completely optional, premium cloud-synchronized features, advanced analytical toolsets, or premium subscription tiers in the future. Introduction of these optional digital bundles will not restrict the core baseline offline functionalities of your pre-purchased physical hardware node. All prices are subject to change without notice, and we reserve the right to refuse or cancel any order at our sole discretion.
When you place an order for the physical esc. puck, the shipment will be routed through third-party logistics carriers dynamically calculated and presented to you at the digital checkout layout.
Title and the absolute risk of physical loss, theft, or transit destruction pass entirely to you, the customer, the exact moment Bedroomlabs SRL transfers the packaged hardware unit to the custody of the respective third-party shipping carrier. We are not responsible for customs clearance delays, international import tariffs, local postal delivery failures, or incorrect shipping coordinates inputted during the storefront checkout sequence. Any estimated delivery windows provided at the time of purchase are non-binding projections.
Upon delivery confirmation logged by the tracking metrics of the selected logistics carrier, you are granted a strict window of seven (7) calendar days to physically inspect the hardware unit for structural integrity or processing defects. Any structural or functional claims must be filed within this 7-day window by contacting hi@bedroomlabs.co.
To secure system integrity and prevent hardware cloning, each physical esc. puck is embedded with a unique cryptographic string identifier. The application layer queries our central database exactly once during the initial setup sequence to verify this string identifier. If the database checks indicate that the specific device string has already been paired to an active ecosystem environment, the pairing sequence will fail, and the device will be deemed restricted. Once a successful initial connection is written, the validation checks transition exclusively to localized, offline contact interaction, and subsequent network queries for that specific hardware key pass entirely into a passive, un-checked state.
Bedroomlabs SRL provides a limited, non-transferable hardware warranty for the physical esc. puck for a duration of twelve (12) months beginning precisely on the date of delivery confirmation. This limited warranty covers exclusively latent material manufacturing defects in the silicon, internal antenna routing, or adhesive casing structures that prevent the NTAG213 chip from transmitting its cryptographic string identifier under normal, standard operating conditions.
If a legitimate manufacturing defect is verified by our engineering logs within this timeframe, we will, at our sole discretion, either issue a replacement hardware node or credit the value back to the original funding account. This warranty is strictly limited to the restoration or replacement of the physical device and does not extend to any associated software performance or real-world events.
The limited warranty outlined in Section 6 is immediately and completely voided if the physical esc. puck exhibits any signs of environmental abuse, physical neglect, or unauthorized optimization attempts. This includes, without limitation, devices subjected to extreme thermal environments, submersion in water or corrosive materials, severe external impact, or structural casing separation.
Furthermore, we enforce a strict zero-tolerance policy against internal module tampering. Any evidence that the original ultrasonic welds, adhesive seals, or structural enclosure lines have been breached, pried apart, or altered will instantly terminate the warranty. The warranty is also rendered entirely void if our database or local logging tools detect that the internal sectors of the NTAG213 chip have been rewritten, wiped, or modified using raw third-party near-field communication applications.
Subject to your strict compliance with these Terms, Bedroomlabs SRL grants you a limited, non-exclusive, non-transferable, revocable, and non-sublicensable license to download, install, and execute the esc. mobile application on personal mobile devices operating authorized versions of iOS or Android. This license is granted solely for your personal, non-commercial productivity and focus management.
You explicitly acknowledge that all structural components of the Ecosystem—including but not limited to the mobile application source code, custom user interface design layers, database pairing protocols, proprietary graphic assets, vector brand marks, 3D casing models, and the "esc." trade name—remain the exclusive intellectual property of Bedroomlabs SRL. Nothing in these Terms transfers any ownership rights, trademarks, or proprietary code libraries to you or any third party.
You agree to utilize the Ecosystem strictly for its intended purpose as a personal screen-time management tool. You are expressly prohibited from executing, or attempting to execute, any of the following unauthorized actions:
The core functionality of the esc. system relies intrinsically on system-level operating system background hooks, specifically Apple's native Screen Time framework and Android's Accessibility and usage statistic engines. You explicitly acknowledge that these underlying framework permissions are governed entirely by Apple Inc. and Google LLC.
Bedroomlabs SRL makes no absolute structural guarantees that the Ecosystem will operate continuously without interruption following major downstream operating system releases. We are not legally liable for any temporary feature degradation, background task termination, or complete focus-mode failures caused by mobile operating system updates that alter, restrict, or deprecate the native API hooks used by the application. While we will make reasonable efforts to ship compatibility patches rapidly, maintaining synchronization with evolving mobile architectures remains out of our absolute legal control.
To the maximum extent permitted by applicable law, in no event shall Bedroomlabs SRL, its founders, or its affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages whatsoever arising out of or related to your use of, or inability to use, the Ecosystem.
This absolute limitation covers, without limitation, real-world consequences such as missed employment obligations, academic or examination failures, missed transportation bookings, professional disruptions, or financial losses resulting from the failure of the esc. system to perform. You explicitly acknowledge that the alarm and application-blocking systems rely on third-party mobile operating system stability, local device battery states, and your own physical device placement. The system is provided on an "As-Is" and "As-Available" basis, and your use of this physical discipline tool is entirely at your own risk.
You agree to defend, indemnify, and hold harmless Bedroomlabs SRL, its developers, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorney's fees) arising directly or indirectly from:
While the core baseline features required to pair and operate your physical esc. hardware node are granted via a one-time purchase, Bedroomlabs SRL reserves the structural right to implement premium, optional cloud-synchronized features or advanced analytical toolsets under a recurring subscription framework in the future.
If you choose to opt into a future premium subscription tier, billing transactions will be handled through authorized platform checkout architectures (such as Apple App Store In-App Purchases, Google Play Billing, or secure web payment integrations). You will be fully responsible for all recurring fees, local applicable taxes, and maintaining valid payment data. All optional subscription tiers will feature a clear cancellation mechanism, and turning off premium services will not restrict the local, offline pairing mechanics of your pre-purchased physical hardware puck.
These Terms remain in full legal force and effect while you utilize any component of the esc. Ecosystem. Bedroomlabs SRL reserves the absolute right, without notice or liability, to terminate or restrict your access to the application layer or block specific hardware string identifiers from querying our database infrastructure if we determine, in our sole discretion, that you have violated these Terms.
Upon termination of your access due to a breach of these terms—including attempts to clone hardware tokens, reverse-engineer app barriers, or exploit payment mechanisms—your right to utilize the mobile software applications will cease immediately. We also reserve the right to initiate appropriate legal actions, including pursuing civil or criminal remedies, under the jurisdiction of our corporate operations.
These Terms, alongside our Privacy Policy, Hardware Refund Policy, and Cookie Policy, constitute the entire legal and operational agreement between you and Bedroomlabs SRL regarding your use of the Ecosystem. Our failure to enforce or exercise any specific right or provision outlined in these Terms shall not operate as a waiver of that respective right or protocol.
If any individual clause, section, or specific sentence within these Terms is deemed unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, that specific provision shall be deemed severable from these Terms. The structural removal or modification of that isolated clause will not affect the legal validity, authority, or enforceability of any of the remaining sections of the contract.
These Terms, your contractual relationship with Bedroomlabs SRL, and any legal actions or friction arising out of your purchase or use of the Ecosystem shall be governed by, interpreted, and enforced in complete accordance with the laws of Romania, without giving effect to any principles of conflicts of law.
You explicitly agree that any legal dispute, formal claim, or judicial proceeding relating directly or indirectly to the storefront, applications, or hardware nodes will be brought exclusively within the competent courts of Vrancea County, Romania. You hereby submit to the personal jurisdiction of and waive any objections as to inconvenient forum rules regarding these specific courts.
